PRIVACY.PROTOCOL

1. Data Controller Information

BinaryVectorLabs is the data controller responsible for your personal data. Our registered address is: Barrio Otánes, 146B, 1º — 39706, Castro-Urdiales, Cantabria, España.

2. Data We Collect

We collect and process the following categories of personal data:

  • Identification data: name, email address, phone number
  • Project data: project descriptions, requirements, and specifications
  • Technical data: IP address, browser type, device information
  • Usage data: pages visited, time spent, interaction patterns

3. Legal Basis for Processing

We process your data based on: (a) performance of a contract (Article 6(1)(b) GDPR), (b) your explicit consent (Article 6(1)(a) GDPR), (c) compliance with legal obligations (Article 6(1)(c) GDPR), and (d) legitimate interests (Article 6(1)(f) GDPR).

4. Data Retention

Personal data is retained for the duration necessary to fulfill the purposes for which it was collected, or as required by applicable laws. Project data is retained for 5 years after project completion for legal and accounting purposes.

5. Data Subject Rights

6. Data Transfers

We do not transfer personal data outside the European Economic Area (EEA) without appropriate safeguards, including Standard Contractual Clauses approved by the European Commission.

We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including encryption, access controls, and regular security assessments.

1. What Are Cookies

REFUND.VECTOR

1. General Refund Policy

BinaryVectorLabs aims to provide high-quality services that meet your expectations. If you are not satisfied with our services, we offer a structured refund process as outlined below.

2. Eligibility for Refunds

Refunds may be issued in the following circumstances:

  • Services not delivered as specified in the project agreement
  • Significant deviation from agreed-upon project requirements
  • Failure to meet agreed-upon deadlines without valid justification
  • Cancellation within 14 days of project commencement (cooling-off period)

3. Refund Process

To request a refund, submit a written request to [email protected] with: project details, reasons for dissatisfaction, and supporting evidence. We will acknowledge receipt within 48 hours and provide a resolution within 14 business days.

4. Partial Refunds

Partial refunds may be issued for services partially completed, calculated based on the percentage of work completed and the stage of the project lifecycle.

5. Non-Refundable Services

The following are not eligible for refunds: domain name registrations, third-party software licenses, completed and approved milestones, and custom development work that has been delivered and accepted.

6. Payment Processing

Refunds will be processed using the original payment method within 30 days of approval. Bank fees or currency conversion costs may be deducted from the refund amount.

TERMS.OPERAND

1. Acceptance of Terms

By accessing or using the services provided by BinaryVectorLabs (located at Barrio Otánes, 146B, 1º — 39706, Castro-Urdiales, Cantabria, España), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Services Description

BinaryVectorLabs provides web development, design, and digital marketing services as described in individual project agreements. Services include but are not limited to: landing page engineering, corporate platform architecture, e-commerce systems, and analytics infrastructure.

3. Project Agreements

Each project will be governed by a separate project agreement that details scope, timeline, deliverables, and pricing. In the event of conflict between these general terms and the project agreement, the project agreement shall prevail.

4. Payment Terms

Payment schedules are defined in individual project agreements. Late payments may incur interest charges of 1.5% per month. BinaryVectorLabs reserves the right to suspend services for overdue payments.

5. Intellectual Property

Upon full payment, all intellectual property rights for custom work developed specifically for the client are transferred to the client. BinaryVectorLabs retains the right to use general methodologies, tools, and frameworks developed during the project.

6. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the project. This obligation survives termination of the agreement for a period of 3 years.

7. Limitation of Liability

BinaryVectorLabs' total liability shall not exceed the total fees paid under the applicable project agreement. We shall not be liable for indirect, incidental, or consequential damages.

8. Termination

Either party may terminate the agreement with 30 days written notice. Upon termination, the client shall pay for all work completed up to the termination date.

9. Governing Law

These terms are governed by the laws of Spain. Any disputes shall be resolved in the courts of Cantabria, Spain.
